Terms and Conditions for Fundraising through iBuytoGive Ltd
We may at some stage need to update our Terms & Conditions. If we do,we will let you know about any changes via a notice on our home pageand/or email directly to you.Each time you use the site, these Terms and Conditions apply.
1. Who we are
The Site is operated by iBuytoGive Limited(“we”, “our”, or “us”). The company is registered in England and Wales under company number 09976006,and our registered office is at; Unit 27, Centurion House, Anson Court, Staffordshire Technology Park, ST18 0AR. Our VAT number is GB 233102857
2. Access to the site to Fundraise with us
2.1. To fundraise with us,you need to be over the age of 18.
2.2.Once you have registered, you must keep your registration details safe. Only one registration per person is allowed.
2.3. For a number of different reasons the site may not be available and/or there will be times when part(s) of the site is/are not accessible to you. We will not be liable if this happens.
2.4. Access to the site is through a password. This is for your security and the site’s security. You must not share your password with any third party. It should always be treated as confidential information.
2.5. Please don’t register as someone else. You must only register on the site as yourself. You must not allow anyone other than yourself to use your account and you must not use anyone else’s account. If you suspect that anyone else has accessed your account, you must let us know immediately. Please send us an email to email@example.com
2.6. When we need to contact you, we will use the email that you provided. Please keep us informed of any changes so that you do not miss any important updates or notifications about your fundraising activities.
2.7. If in our opinion, you have failed to comply with these Terms, we reserve the right to restrict or not let you have access to all or some parts of the site.
3. Your Obligations
3.1. By setting up a fundraising page,youagree to only forward any funds raised directly to the Charity or Good Cause that you have nominated. For Charities, we will only pay directly into the Charities bank account and for a Good cause a verified bank account.
3.2. If you are a Charity, you authorise us to allow donators to complete forms for the collection of Gift Aid. These forms will be forwarded to you for you to claim accordingly.
3.3.We will ask the buyers and donators if we can pass on their direct contact details to you. If they agree,then you agree to comply with all relevant data protection and privacy legislation.
3.4. You must not be in any violation of any law or be defamatory, rude, or in breach with any intellectual property rights of any third party.
3.5. If you have a logo or trademark and it’s uploaded to our site, you are allowing us to display it totally royalty free.
3.6. For us to pay you, you need to send us bank details which we will check if for a charity or verifyfor a standard fundraising campaign. All bank accounts must be with a recognised UK based financial institution.
3.7 Any refund requests received from a donor/fundraiser in respect todonations will be passed to you including any merchant card fees we may incur.
3.8 You allow us to send emails to you on a regular basis to update you with relevant information with regards to our website.
4. iBuytoGive Limited Obligations
4.1. We will donate to your Charity or Good Cause if someone is directed from your Fundraising or Charity page and purchases anything from our online shop www.ibuy2give.co.uk. We will pay you 30 days in arrears from the date of purchase. The reason for this is that sometimes items bought are returned, and in those cases, we do not want to ask you for the donation back. Donations that result from any Affiliate sales are paid as and when we get paid by the Affiliate.
4.2. When a direct donation is paid to you, we take a fee of 1.8% plus 20p which covers our processing costs and the Merchant Card Fees that we are charged.
4.3. Personal details. We will collect, protect and secure all personal details of any fundraisers, buyers or donators in accordance with the data protection act 1998. Any fundraiser that has chosen to pass their personal details onto the site for the purposes of fundraising does so at their own risk,and we cannot be held liable for any such disclosure. We will ask the buyer or donator if we can pass on their contact details to you once they have donated or made a purchase.
4.4. You will be provided with access to a password protected secure user account accessible through our website. From here, you will be able to produce reports on the details of all the donations and the amount plus details of all purchases and the amount we have donated.
5.1. You authorise us to receive donations for your campaign, and for us to make transfers to the relevant bank account. We will only deduct the merchant card company fee which we have to pay to them.We will only pay in Pounds Sterling.
5.2. We can refuse to pay you if we are reasonably satisfied that you are fundraising illegally and being fraudulent.
6.1. You can terminate your fundraising with us at any time. If we still have any money owing to you from donations or purchases,we will pay that money to you. However, we cannot be held liable or responsible for any loss that you may suffer as a result of you terminating iBuy2Give Services.
6.2. We can terminate your campaign with us at any time for any reason. If we do and you still have money owing to you from donations or purchases, we will pay that money to you. However, we cannot be held responsible for any loss that you may suffer as a result of terminating iBuy2Give Services.
